Can Indians invest in the US without a visa?

Yes. Indian nationals can invest in US real estate, stocks, bonds, and businesses without a US visa. Foreign nationals face no restrictions on purchasing US real estate or investing in US businesses. However, active business management typically requires appropriate work authorization. We advise on structuring investments correctly from India.

The EB-5 Immigrant Investor Program grants US permanent residency to investors who invest $800,000 (in targeted employment areas) or $1,050,000 (standard) in a US enterprise that creates at least 10 full-time jobs. Regional center investments are the most common path. Processing times have improved significantly and priority dates for India-born are currently favorable relative to employment categories.

Most Indian investors use a Delaware C-Corporation or Wyoming LLC as the primary US holding entity. For real estate investment, a separate LLC per property (or per portfolio) provides liability isolation. A Delaware holding company above US operating entities offers tax flexibility. Indian nationals can purchase US real estate directly or through US LLCs. Common approaches: (1) Personal purchase with foreign funds wire transferred to title company; (2) LLC purchase for rental properties (liability protection, potential tax benefits); (3) Delaware/Wyoming holding company for multiple properties. FIRPTA withholding applies on disposition — proper planning reduces this significantly.

Single-family rentals in Texas, Florida, and Arizona typically yield 5–9% gross rental yields. Midwest markets (Ohio, Indiana, Missouri) offer 8–12% gross yields on cashflow-focused properties at lower entry prices. Commercial real estate (multifamily, industrial) typically yields 5–7% cap rates. Dollar appreciation against INR historically adds 3–5% annually to total returns.
