These terms apply to all visitors, users, consultation enquirers, and any other persons who access or use our services. We reserve the right to update these Terms at any time. Continued use of our services after any changes constitutes your acceptance of the revised Terms.
2. Nature of Services
Liberty Gateway USA is a private immigration and US relocation advisory platform. We provide strategic advisory services, information, and facilitation of connections with licensed professionals including US immigration attorneys, CPAs, and real estate advisors.
Liberty Gateway USA is not a law firm and does not provide legal advice. Our services are advisory and facilitative in nature. We do not represent clients before USCIS or any US government agency. All legal representation is provided by independently licensed attorneys in our professional network, with whom you will enter into a separate engagement agreement.
Nothing on this website constitutes legal, financial, tax, or investment advice. You should not act on information from this website without seeking independent professional advice relevant to your specific circumstances.
3. Eligibility
Our services are intended for adults aged 18 years and above. By using our services, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
Our services are primarily directed at Indian nationals and persons of Indian origin who are exploring US relocation, immigration, investment, and business establishment. Services may vary based on your country of residence and specific circumstances.
4. Consultation Engagements
Consultation requests submitted through our website initiate a preliminary advisory engagement. Initial consultations do not create an attorney-client relationship. Any formal engagement with a licensed US immigration attorney or other licensed professional in our network is governed by a separate written agreement with that professional.
We reserve the right to decline any consultation request at our sole discretion. We also reserve the right to terminate an advisory engagement if, in our professional judgement, a client relationship cannot be maintained productively or ethically.
All information shared during consultations is treated with strict confidentiality, consistent with our Privacy Policy. However, confidentiality obligations between you and any separately engaged licensed attorney are governed by the terms of that separate engagement.
5. Fees and Payments
Advisory fees are communicated clearly prior to the commencement of any paid engagement. Fees may vary based on the scope and complexity of the services required. All fees are in Indian Rupees (INR) or US Dollars (USD) as specified in your engagement agreement.
Payments made for advisory services are generally non-refundable once work has commenced. In cases where a consultation has been booked but not yet conducted, a cancellation request submitted at least 48 hours in advance may be eligible for a full refund or rescheduling at our discretion.
Government filing fees, attorney fees, and third-party professional fees are separate from Liberty Gateway USA advisory fees and are payable directly to the relevant authority or professional.
6. No Guarantee of Immigration Outcomes
Immigration decisions are made by the US Citizenship and Immigration Services (USCIS), US Department of State, and other relevant government authorities. Liberty Gateway USA makes no guarantee or representation regarding the outcome of any immigration application, visa petition, or related proceeding.
Our role is to provide strategic guidance, prepare high-quality documentation, and connect you with qualified legal counsel — not to influence or predict government decisions. Immigration laws and policies are subject to frequent change, and outcomes can be affected by factors outside our control.
7. Intellectual Property
All content on this website, including but not limited to text, graphics, logos, icons, images, audio clips, digital downloads, and software, is the property of Liberty Gateway USA or its content suppliers and is protected by applicable intellectual property laws.
You may access and use content on this site for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our prior written consent.
8. User Conduct
You agree not to use this website for any unlawful purpose or in any manner inconsistent with these Terms. 10. Limitation of Liability
To the maximum extent permitted by applicable law, Liberty Gateway USA and its officers, directors, employees, agents, and advisors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to immigration application denials, financial losses, or reliance on information provided on this website.
Our total aggregate liability for any claim arising out of or relating to these Terms or our services shall not exceed the fees paid by you to Liberty Gateway USA in the three months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless Liberty Gateway USA, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorney fees) arising out of or relating to your violation of these Terms or your use of our services.
12. Governing Law and Dispute Resolution
These Terms of Service shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising out of or in connection with these Terms shall first be subject to good-faith negotiation between the parties.
If a dispute cannot be resolved through negotiation within 30 days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996 (India), with proceedings conducted in Mumbai, Maharashtra, in the English language.
13. Severability
If any provision of these Terms is held by a court or arbitral tribunal to be unlawful, void, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms.
