Frequently Asked Questions

Answers to the most common questions about US immigration for Indian nationals.

Which visa is best for an Indian entrepreneur wanting to move to the US?

Indian entrepreneurs typically have three strong options: the L-1A visa (intracompany transfer for executives), the E-2 Treaty Investor visa, or the EB-5 Immigrant Investor program. The best fit depends on whether you have an existing US-linked entity, the capital you can deploy, and your long-term residency goals. An L-1A is ideal if you already have a business in India and want to establish a US subsidiary.

India-born applicants face significantly longer wait times due to per-country caps. For EB-2 and EB-3 categories, current backlogs are 50–100+ years. EB-1A (extraordinary ability) and EB-2 NIW offer faster timelines with no employer sponsor required. EB-5 investment visas currently have a shorter backlog. Strategic planning and category selection are critical for Indian nationals.

Yes. Indian nationals apply at US consulates in Mumbai, Delhi, Chennai, Hyderabad, and Kolkata. Non-immigrant visa appointments are available within weeks to a few months depending on category. Immigrant visa processing is handled by the National Visa Center after USCIS approval.

The EB-2 NIW allows foreign nationals with advanced degrees or exceptional ability to self-petition for US permanent residency without a job offer or PERM labor certification, if their work benefits the US national interest. Doctors, researchers, engineers, and professionals with published work or specialized expertise are strong candidates.

Indian doctors can pursue several pathways: the J-1 Exchange Visitor Visa for residency training (with or without waiver programs), the H-1B for employed physicians, EB-2 NIW for those meeting national interest criteria, or O-1 for those with extraordinary clinical accomplishments. USMLE certification is typically required.

Documentation varies significantly by visa category. Generally required: valid passport, photographs, DS forms, financial evidence, employment/education records, and petition-specific documents (I-140 for employment-based, I-130 for family-based, business financials for E-2/EB-5). Our advisory team prepares a complete, category-specific document checklist.
